OnTheTools is a registered business name of J.T Kalyvas & J Perazzoli, a general partnership established in Australia, ABN 91 588 670 887. References to "OnTheTools", "we" or "us" in these terms mean that partnership. These terms are governed by the laws of Australia.
These Terms and Conditions govern use of OnTheTools ("the platform", "we", "us") by clients posting jobs and tradies offering trade services (together, "users", "you"). By creating an account you agree to these terms. If you don't agree, please don't use the platform.
OnTheTools is a marketplace that connects clients who need trade work done with tradies who offer it. We provide the app, messaging, job posting, quoting, and payment-holding tools. We are not a party to the contract for work formed between a client and a tradie, we do not employ or supervise tradies, and we do not guarantee the quality, safety, timeliness, or legality of any work performed. Clients and tradies deal with each other directly and are responsible for their own arrangement.
You must be at least 18 years old and able to form a binding contract to use OnTheTools. You agree to provide accurate information (including any trade, licensing, or ABN details) and to keep your account credentials secure. You're responsible for all activity under your account.
Where a tradie provides an ABN, licence, or qualification information, OnTheTools may display it but does not independently verify it in all cases. Clients should conduct their own checks (such as confirming licensing, insurance, and qualifications) before engaging a tradie for work, especially licensed trades or higher-value jobs.
When a client pays an invoice through the platform, funds are held by OnTheTools until the tradie marks the job complete and the client confirms and releases payment. A platform fee is deducted from the amount paid to the tradie. Held funds are not OnTheTools's property and are released according to the completion process in the app. Refunds or reversals for disputed work are handled case-by-case and are not automatic.
Be honest and fair. Clients should describe jobs accurately, respond to quotes in good faith, and release payment promptly once work is genuinely complete. Tradies should quote honestly, perform work as described, and communicate delays or issues promptly. Both sides should communicate respectfully - harassment, threats, discrimination, or abusive language toward another user will not be tolerated and may result in account suspension.
Reviews (of tradies by clients, and of clients by tradies) must reflect genuine experiences from a completed job. Fake, retaliatory, or manipulated reviews are prohibited. We may remove reviews that violate this or that contain abusive content, but we are not obligated to mediate every rating dispute.
You retain ownership of photos and content you upload. By uploading job-posting photos, you agree they may be shown publicly to tradies browsing jobs. Completion photos a tradie uploads are only shown publicly if the client explicitly consents via the in-app consent choice - otherwise they're used only to confirm the job between the two of you. Don't upload anything you don't have the right to share, or anything illegal, offensive, or identifying people without their consent.
You agree not to: circumvent the platform's payment or fee system by arranging off-platform payment for a job originated on OnTheTools; provide false information about your identity, qualifications, or a job; use the platform for unsafe, unlicensed, or illegal work where licensing is legally required; or attempt to scrape, hack, or disrupt the platform.
OnTheTools is provided "as is" without warranties of any kind. To the maximum extent permitted by law, OnTheTools is not liable for the acts or omissions of any user, the quality or safety of work performed, property damage, injury, or any dispute between a client and a tradie. Users engage each other at their own risk and are encouraged to use good judgment, check credentials, and consider their own insurance arrangements.
If a disagreement arises between a client and a tradie, we encourage resolving it directly through in-app messaging first. OnTheTools may, at its discretion, help mediate a dispute over held funds, but is not obligated to act as an arbitrator and its decisions in doing so are not a substitute for legal advice or legal remedies either party may have.
We may suspend or terminate an account that violates these terms, engages in fraud, or creates risk for other users. You may stop using the platform and close your account at any time.
We may update these terms from time to time as the platform evolves. Continued use of OnTheTools after an update means you accept the revised terms.
